Clark—revealed flaws in how his involvement was interpreted, opening the door for his case to be reconsidered. With the passage of SB 1437, which redefined aspects of the Felony Murder Rule, Stephen’s final legal battle, taken on pro bono by attorney Elizabeth Richardson-Royer, led to his release.

As the founder of Ndigena, LLC, and co-founder of R&D Music Group, Thomas produces powerful stories like Return From the Dead, focusing on elevating voices often overlooked. He also played a key role in the launch of the creative agency, ConCreates, leading its creative execution and helping to redefine how society views formerly incarcerated individuals.

I believe in the power of media to drive advocacy and spark necessary conversations. Return From the Dead was born from my firsthand experience within the justice system and a lifetime spent learning of its complexities. This story took shape when I witnessed and advocated for Stephen Bennett’s release during his resentencing—a pivotal moment that shed light on both the harsh realities and potential for redemption within the system.

Documenting Stephen’s release revealed the challenges of reentry and the personal transformation required to navigate freedom after facing life without parole. Stephen has opened his story to help others come home and reenter society, shifting from the mindset of life in confinement to the pressures and decisions of a life on the outside, all under heavy scrutiny and high expectations. His case, In re Bennett, has already created new pathways for others, but those coming home need resources and direction to make their return sustainable and meaningful.

3 Strikes Reform

California’s 3 Strikes Law, enacted in 1994, imposed life sentences for individuals convicted of three serious or violent felonies. While intended to deter repeat offenders, it often resulted in harsh and disproportionate outcomes. In Stephen Bennett’s case, his involvement in a robbery that resulted in a death triggered California’s Felony Murder Rule, making him eligible for a special circumstances charge. Although he was not the shooter, the way the charges were applied led to multiple strikes under the 3 Strikes Law. This resulted in a life sentence without the possibility of parole, compounded by additional terms under California’s sentencing guidelines.

SB 1437

Passed in 2018, SB 1437 redefined California’s Felony Murder Rule, limiting the ability to charge individuals with murder if they did not directly kill or intend to kill. This was a pivotal change in justice reform, offering a second chance to those who were unfairly swept up by harsh sentencing laws. For Stephen Bennett, this law was instrumental in overturning his special circumstances conviction, giving him a path to freedom after years of legal battles.

Reentry Challenges

For many formerly incarcerated individuals, returning home is just the beginning of a new struggle. Reentry comes with numerous challenges, including limited job opportunities, housing restrictions, and the stigma of a criminal record.
